Rethinking this I'm pretty sure I got it wrong. If the Captains deck is empty them one cannot draw 3 cards, therefore one cannot fulfill the requirements of the even if one has cards in hand to discard.

I was pretty sure that was the case too, but it didn't make a big difference at the point of the game in which it occurred, so I let it be. However, as it came up as a question for us, it may also come up as a question for others, so I decided to post the question.
